VY employees: Vt. threat violates their civil rights
Friday June 24, 2011BRATTLEBORO -- Seven reactor operators, with a total of 117 years of employment at Vermont Yankee nuclear power plant in Vernon, filed suit against the state late Wednesday accusing it of attempting to deprive them of their civil liberties.
In the suit, Michael Harris, John Twarog, Derek Jones, Vincent Ferrizzi, Albert Zander, Neal Jennison and Thomas Roberts contend the state's refusal to issue a certificate of public good for the continued operation of Yankee will cause substantial hardship and injury to them and their families.
David Cleary, their attorney, said the Legislature's passage of Act 160, which gave it the authority to forbid the Vermont Public Service Board from issuing a certificate of public good for Yankee's continued operation past March 21, 2012, is a gross violation of their protected property rights under the Civil Rights Act.
"My clients' view, with which I firmly agree, is that no government should have the right to deprive them of their jobs, their livelihoods and their ability to support their families without due process of the law," he said.
"If the federal government says it's OK to keep my job that it oversees, what right does (Governor) Peter Shumlin have to say I don't have that right?" asked Michael Ferrizzi of Newfane. "What stops them from saying the same to anyone else in the state?"
Ferrizzi, who spent nine years in the Navy and performed the duties of a reactor operator, has been at Yankee for 15 years and is a senior reactor operator.
He is originally from Pennsylvania, but his two children, 6 and 10 years old, are genuine Vermonters.
"They were both born at Brattleboro Memorial Hospital and go to Newfane Elementary School," said Ferrizzi. "This is home to them and this is home to me. This is where I want to stay."
Derek Jones, also of Newfane, has lived in Vermont for 12 years.
A former nuclear machinist in the Navy, he came to Vermont for a job at Yankee.
Like Ferrizzi, he is concerned for his children's future.
"They're Vermonters," Jones said.
He said in addition to the personal toll of having to move his family to another state, starting over at another plant would be difficult for him professionally because his license is only good at Yankee. He would have to be recertified to work as a reactor operator anywhere else in the state.
